miguel-a-ramirez-18261-copy-217x300There are often controversies regarding jail and prison inmates’ rights. However, it is well established that all prisoners in state and federal facilities are entitled to receive adequate physical and mental health care. They are entitled to have their injuries, physical medical conditions, and psychological conditions reviewed by a physician, diagnosed, and treated. However, stories of negligent medical care in California facilities, some of which have led to inmate deaths, have gained more attention in recent years. Now it has come to light that the health care system within California’s prisons may be entirely inadequate to provide appropriate care.

If your loved one is currently incarcerated and is not receiving proper medical attention for a physical or mental condition, contact a San Francisco civil rights lawyer from Brod Law Firm right away.

shane-rounce-268118-copy-300x199Garbage trucks are a constant presence on city streets and highway. While they are providing a crucial civic service, these sizable vehicles are sometimes part of serious collisions.

On Thursday, August 10, a garbage truck was involved in a collision with at least one other vehicle on Interstate 280, north of Alemany Boulevard. The truck driver appears to have lost control, hit the center divider, and eventually ended up with the cab on the shoulder of southbound lane of I-280, while the trailer was in the northbound lane of I-280.

It was not immediately clear whether anyone suffered serious injuries. However, it was reported that at least one person was taken to the hospital.

matthew-hamilton-135738-copy-300x200On March 13, 2016, Robert and Ruth Robinson requested an Uber through the phone app. They were picked up by driver Baher Tamim. The Robinson’s allege that Tamim’s negligence caused his vehicle to crash into another car that was stopped at a red light near Post Street in San Francisco. In a lawsuit filed in April against Uber, its wholly owned subsidiary Rasier LLC, and Tamim, the Robinsons cliam that the driver’s negligence behind the wheel caused them injuries.

Ride-sharing services like Uber have become extremely popular around the country. They can be incredibly convenient and can increase safety on the roads by ensuring that overly tired or inebriated individuals do not drive. However, ride-sharing drivers are normal individuals. They are not trained or expert drivers, and they can be careless, reckless, and intentionally harmful when driving. When this behavior causes an accident and results in their passengers becoming injured, the drivers and the ride-sharing companies face civil liability.

If you were injured in an accident caused by your ride-sharing service driver’s negligence, contact an experienced San Francisco personal injury attorney from Brod Law Firm. Uber and other services carry insurance plans, but you may need help filing a successful insurance claim or representation for a personal injury suit.

dawn-armfield-66060-copy-300x225A construction site on San Pablo Avenue between Oakland and Emeryville caught fire on Saturday, May 13. The fire broke out in the mixed-use apartment complex around 5 a.m. and took about 100 hours to control. Both the Oakland Fire Department and the Alameda County Fire Department sent engines and firefighters. The debris was still smoldering and firefighters remained on site through Sunday. The fire led to the evacuation of at least 35 residents from 15 neighboring units as officials were worried the partially burned crane might collapse. Some nearby homes were severely damaged.

This is the second time the construction site has gone up in flames. It caught fire last July, and neighbors and the building developers suspect arson. The previous fire started at around 2:45 a.m. and also spread to nearby homes and businesses.

The development was intended to be 105 one- to four-bedroom units and 21,000 square feet of retail space known as the Intersection. However, it remains to be seen when the Intersection will come to fruition. The building was supposed to be finished this October. However, this has set it back at least nine months.

hogarth-de-la-plante-17754-copy-300x179On May 1, the San Francisco Bay Area experienced at least three fatal traffic accidents between midnight and 5 in the morning. The first accident took place on Highway 880 in San Leandro, just south of Marina Boulevard. Two vehicles were part of the initial collision, though a total of four vehicles were involved. The driver of one vehicle died at the scene while another driver was taken to the hospital with major injuries. The other motorists were uninjured.

The second incident was on Highway 101 in San Francisco. A pedestrian walking within a crosswalk was hit by a motorist who lost control of his vehicle. Initial reports are that the motorist left the scene but later reported hitting the pedestrian through 911 and has been interviewed by investigators. There is no evidence that the driver was intoxicated at the time and no arrest has been made.

The third accident was also on Highway 880, but this time in Oakland. Three vehicles were involved in the crash and one of the vehicles caught on fire. Two individuals were killed, a 34-year-old man and a 4-year-old girl who was not properly restrained in a child safety seat. An initial statement by the California Highway Patrol said one of the diver’s may face charges for the unrestrained child’s death. Other passengers, including a 2-year-old girl, were hospitalized.

Vehicle Fires in the U.S.

freestocks-org-126848-copy-300x200Coumadin and other blood thinners are commonly used by elderly individuals. These individuals are often prescribed this type of medication to reduce the chance of heart attack, stroke, and other major medical events. However, blood thinners are serious medications and patients taking them need to be closely monitored by a physician or nursing home staff. Being on this type of medication when it is unnecessary or taking too much can lead to injuries and fatalities. In fact, ProPublica and The Washington Post found that 165 nursing home residents were hospitalized or died after suffering from Coumadin, or the generic Warfarin, errors between 2011 and 2014. These incidents are preventable when elderly patients are given proper care.

The Dangers of Failing to Monitor Blood Thinners

Coumadin has well-documented benefits. However, when patients are given too much or too little of a blood thinner, they are put at risk for serious health issues and early death. For instance, when patients who are at risk for negative health events are given too low of a dosage or not given their prescribed medication, they remain highly at risk for blood clots, stroke, and heart attack. When elderly individuals are prescribed or unnecessarily given too much of a blood thinner, they can suffer internal bleeding. Warfarin can also dangerously interact with other medications like commonly prescribed antibiotics. If physicians and other nursing home staff are not on the lookout for common medication interactions, then elderly patients are seriously at risk for injuries.

lili-popper-29464-300x169It turns out, you do not have to be in a car to get into a car crash. You can be involved in an auto accident while sitting in your living room. On March 26, a vehicle struck home after being involved in a traffic accident, according to the Redwood City Fire Department. The original two-vehicle collision occurred at 34 Center Street around 8:00 p.m. There were no reports of injuries in this particularly incident. However, not all families are so lucky.

While vehicle-into-building accidents are not as common as traffic collisions, they are not so few and far between that you can ignore the risk. Some statistics say around 60 vehicles crash into commercial buildings per day across United States. The rate is likely higher when including residential houses and apartment buildings. If you are injured by a vehicle colliding with the building you were in, whether at home or work, contact an experienced San Francisco personal injury attorney at Brod Law Firm.
